Unlocking compliance: Understanding the new EU General Product Safety Regulation (GPSR)

The EU General Product Safety Regulation (GPSR) has far-reaching implications within a product’s supply chain. Few exporters of consumer goods will be left untouched by this regulation and failing to comply could result in your product being hidden from potential customers or receiving a penalty so it is essential to understand these new rules. Here’s what you need to know…

What is GPSR?

GPSR was introduced by the EU in December 2024. Its purpose is to protect EU consumers from dangerous and fake products being sold both in person or online.

The new legislation replaces the EU’s General Product Safety Directive (GPSD) in response to the rapid growth of e-commerce and new technologies, and brings product safety rules up to date. It applies to all EU member states, as well as retailers, manufacturers, importers and distributors who supply goods to the EU market.

What key changes have been introduced in the legislation?

One of the key changes is the appointment of a responsible person, such as an authorised representative, importer or manufacturer, who acts as the primary point of contact for regulators. For manufacturers based outside the EU, they will have to appoint a responsible person based in the EU.

The name or company name of the responsible person, mail and email address and a telephone number must be clearly visible on either the product, the packaging or accompanying documentation.

Clear obligations for economic operators are also in effect to ensure safety within the supply chain. GPSR has bestowed strict rules and responsibilities upon economic operators, such as manufacturers, importers, and distributors, including storage requirements, supporting ongoing investigations and providing documentation like test certificates and risk assessments.

How does GPSR affect trade between the UK, Northern Ireland, and the EU?

GPSR is in place to protect EU customers from illegitimate and dangerous products, meaning that manufacturers outside of the EU will have to follow strict regulations.

GPSR applies to products exported from the UK to the EU and Northern Ireland markets, but does not impact products coming into the UK. The rules apply to most products including new, used, repaired and reconditioned products. Exempted products from GPSR include medicinal products, food and feed, living animals and plants, low-risk aircraft and antiques.
